We are very pleased to announce the release of the World Law Group (“WLG”) Merger Control Basics 2010. This booklet provides information on merger control filing thresholds and merger control deadlines in 53 jurisdictions worldwide. It therefore provides information on two of the most important questions related to the preparation of multi-jurisdictional merger control filings. Greek Law and Jurisprudence on Infringements of Personal Privacy & Personality Rights

Article 9 par. 1 of the Greek Constitution provides that: “The private and family life of the individual is inviolable”. Article 8 par. 1 of the European Convention on Human Rights, as enacted into Greek Law by Law 53/1974, provides that: “Everyone has the right to respect for his private and family life, his home and his correspondence”.

International Licensing / Nature of Licensing Agreements

There are three (3) principle legal methods that can be used in order to bring about a commercial transfer and acquisition of technology, namely: a. The Sale (i.e. Assignment), b. The License Agreement and c. The Know-How Agreement. The commercial transfer of technology through a license is the giving by the owner of a patented invention to another person or legal entity of the permission to perform, in the country and for a limited period of time, one or more of the acts which are covered by the exclusive rights of the owner of the invention patented in that country. When that permission is given, a “license” has been granted.

Use and transfer of medical and clinical data in Greece

As clinical trials, drug development, collaboration, licensing arrangements and pharmacovigilance expands in Greece, data protections issues will increase in importance. An enhanced understanding of the Greek data protection framework will be necessary, particularly as respects collection and transfer abroad of medical and clinical data stored or originating in Greece. Clinical trial researchers, sponsors and others will want to be aware of and ensure that appropriate precautions have been observed and that use of the data is permitted.
