Getting the Deal Through – Product Recall 2014 – Greece

The basic legislative documents that set the Greek legal framework on product safety are Ministerial Decision Z3/2810/14 of December 2004 (the MD), which implemented EU Directive 2001/95/EC on General Product Safety (GPSD) and Law 2251/1994 on Consumers’ Protection (usually referred to as the Consumers’ Law, as in force today – Law 2251), which, inter alia, implemented EU Directive 85/374/EEC on the approximation of the laws, regulations and administrative provisions of the member states concerning liability for defective products (as amended by EU Directive 99/34/EC, the PL
Directive). The above legal framework is supplemented by Regulation (EC) No. 765/2008 setting out the requirements for accreditation and market surveillance relating to the marketing of products, in force as of 1 January 2010.

ICLG – Product Liability 2014 – Greece

Law 2251/1994 on “Consumers’ Protection” (“Consumers’ Law”), which implemented EU Directive 85/374/EEC “on the approximation of the laws, regulations and administrative provisions of the Member States concerning liability for defective products” (as amended by EU Directive 99/34/EC), sets the main product liability rules in Greece (articles 6 & 7). Moreover, Ministerial Decision Z3/2810/14.12.2004 (“MD”) implemented EU Directive 2001/95/EC on “General Product Safety”. Although the Consumers’ Law was amended several times until today (for the last time by Law 4177/2013), extensive amendments were introduced in 2007 (by Law 3587/2007).

Merger Control in the Balkans

Mergers and acquisitions (together, the Concentrations) are subject to merger control under Law 703/1977 “on the control of monopolies and oligopolies and the protection of free competition”, as amended repeatedly and for the last time by Law 3373/2005 (the Competition Law), provided the thresholds imposed by the Law are met.
